Regulations of domain registration in zone AZ
This document determines domain registration regulations
in national segment AZ of Internet network. AZ is officially recognized
code of the Azerbaijan Republic in accordance with ISO 3166-1 international
standards. Registration of domain names are conducted based on recommendations
of international organizations ICANN and IANA.
I. General regulations
Concepts below are used in these regulations:
1.1. Domain – space within the World Wide Web managed in centralized manner
and served by domain names’ servers (DNS). Domain is identified by domain
name.
1.2. Domain registration – input of information on domain to the database.
1.3. Domain administration – implementation of organizational and technical
arrangements to provide domain’s functioning.
1.4. Cancellation of registration – discard of information on domain from
database.
1.5. Administrator – legal person conducting registration and administration
of domains.
1.6. Registrar – legal person conducting registration and administration
of domains based on the contract with Administrator.
1.7. Registrant – natural or legal person, state or local self-governing
body using domain name.
II. Registration of domains in zone AZ
2.1. Registration and technical support of domains are conducted on the
basis of contract signed by Administrator/Registrar and Registrant.
2.2. Person desiring register domain name sends properly filled application
form to the e-mail address of Administrator: info@nic.az.
2.3.Proper application form for domain registration in AZ zone can be
obtained on registrator's site :

2. Penki kontinentai Baku (www.extraweb.az)
2.4. Application form for domain registration in AZ zone can be sent to
the e-mail address of Registrant.
2.5. One application can be used only for one domain name.
2.6. Confirmation of application’s receipt is sent within 24 hours.
2.7. All applications are considered on the same standards.
2.8. Correctly composed application is examined during three working days,
and information about it is sent to Registrant. If required, Administrator/Registrar
can demand documents confirming information reflected on application.
2.9. All connective people mentioned on the application must be available
by e-mail. Otherwise the Administrator/Registrar is not responsible if
they don’t get informed.
2.10. In cases if more than one applications for registration of the same
domain name are received, they will be examined by the order of their
arrival time.
2.11. Contract between Administrator/Registrar and Registrant is signed
after receiving positive reply to the application.
2.12. If one person applies for registration of more than one domains,
he must sign contracts for each of them separately.
2.13. Registration term of domain name is 1 year.
2.14. Regulation for carrying out payments in accordance with earlier
defined prices for registration and technical support of domains in AZ
zone is defined based on the contract signed by Administrator/Registrar
and Registrant.
2.15. Domains of “common use” include such GENERIC type domains as com.az,
org.az, mil.az, edu.az, biz.az, qov.az, info.az, pp.az, name.az, net.az,
int.az. Decision to award to other domains the “common use” status is
made by Administrator. “Common use” domains are registered in below order:
com.az, co.az - commercial organizations
org.az - non-commercial organizations
mil.az - military forces
edu.az - education institutions
biz.az - business activities
gov.az- state and local governance bodies
info.az - mass media
pp.az, name.az - natural persons
net.az, int.az - organizations and projects participating in development
of Internet network.
III. Demands made during registration of domain names
3.1. At the time of contract signing Registrant has to possess at least
two DNS servers (primary and secondary) providing functioning of domain
name. These servers have to be placed in two separate IP networks and
reliably connected to the Internet. “Reliable connection” means that communication
delay with the server must occur not longer than two hours a day. Maintenance
of mentioned servers should correspond to the requirements determined
by international documents (RFC-1032, RFC-1033, RFC-1034 and RFC-1591).
Information on domain name servers has to be conformable to the current
status of network.
3.1.1 Condition of domain delegation is the reception of positive results
of correctness checking in functioning of specified domain names (primary
and Secondary DNS) by the Registrant containing configuration files of
the registered domain.
In case of non receipt of positive results of correctness checking in
functioning of domain names servers, DNS - servers testing stops. Repeated
procedure of DNS - servers testing is initiated by Registrant sending
registration form of corresponding sample to the registrar.
3.1.2 The information, concerning domain names servers should correspond
to a current condition of a network.
3.1.3 In case of default of the conditions stated in items 3.1.1 and 3.1.2,
the registrar has the right to stop domain delegation during all validity
of registration.
Delegation can be restored only after elimination of the specified infringements.
3.2. Domain name must contain minimum 3 and maximum 63 symbols (characters
of Latin alphabet, numbers, dash “-“).The dash cannot be used at the beginning
and end of the domain name.
3.3. For the registration of domain names for state and local self-governing
bodies of the Azerbaijan Republic it is recommended to use third level
zone qov.az.
3.4. Registrant is advised to choose domain name suitable to its own name.
Registrant must not use geographical names, other persons’ names and well-known
trade marks as a domain name.
3.5. Administrator/Registrar is not responsible, if Registrant violates
rights of other persons or organizations by using names or trade marks
belonging to them.
3.6. Following are reflected in database:

3.7. Registrant is responsible to provide actuality of information about
him/her/it reflected in database. Registrant must inform Administrator/Registrar
about it within one month in cases of any change or update of information
in database. 3.8. Administrator/Registrar promptly informs (notification)
Registrant using all contact forms, information on which is reflected
in database, on any inexactitude in database information provided by Registrant
during registration time, if such take place. If Registrant doesn’t provide
within month new information or documents demonstrating credibility of
above-mentioned information, registration of domain name will be cancelled.
Rejection of domain name registration
4.1. In following cases registration of domain name can be rejected:
if claimed domain name has already been registered under other persons
name;
if documents submitted for the registration of domain name have not been
properly executed;
if unethical and unquotable words or phrases are used in domain name;
if not conformed to the technical rules indicated in item 3.1.;
if domain name has not been constructed in conformity with the rules indicated
in item 3.2.;
if use of this domain name violates rights of other persons and organizations
(if the name of other legal entity, trade mark or natural person is used).
4.2. Substantiated decision on rejection of registration of domain name
is presented to Registrant within 3 days. Registrant can file an appeal
against this decision.
V. Re-registration of the domain name
5. A month before termination of registration Administrator sends to
the Registrant inquiry about prolongation of registration term. If within
this period Registrant doesn’t apply for prolongation of term, after termination
date of contract the domain name will be canceled. After Registrant’s
application for prolongation of domain name’s registration, the contract
with him is prolonged for 1 year and information on domain name is held
in database for next registration term. At prolongation of the contract
its conditions may be changed on the basis of a bilateral agreement.
VI. Administration of domains
6.1. Administrator/Registrar doesn’t take part in relations between Registrant
and any third party for the administration of domain.
6.2. Domain name is not subject for property right and cannot be a subject
for purchase and sale contract.
6.3. Assignation of domain name to other legal entity or natural person
can take place only after the written application of Registrant.
6.4. A new contract on registration of domain name between Administrator/Registrar
and new owner of domain name is signed.
6.5. In following cases domain name’s registration can be cancelled before
termination date:
As per Registrant’s application;
As per court decision;
In cases indicated in contract between Administrator/Registrar and Registrant;
In other cases envisaged by the legislation of the Azerbaijan Republic.
6.6. In following cases technical support of domain name can be stopped
immediately:
As per Registrant’s application;
If as a consequence of change of information on DNS the rules indicated
in item 3.1. is not observed.
In cases indicated in contract between Administrator/Registrar and Registrant;
In other cases envisaged by the legislation of the Azerbaijan Republic.
6.7. Administrator/Registrar informs Registrant within 24 hours on decision
on cancellation of domain name registration before termination date or
stopping technical support of domain name.
6.8. Administrator/Registrar restores technical support of domain name
within 24 hours after elimination of cases causing stoppage of technical
support. Stoppage time of technical support of the domain name doesn’t
cause proper break of registration term’s flow.
6.9. Registrant can file an appeal against the decision of Administrator/Registrar
on cancellation of domain name registration before termination date or
stopping technical support of domain name.
VII. Resolution of arguable points related to registration and
administration of domain name
7.1. All arguable conditions related to the registration and administration
of domain name are examined in accordance with the proper legislation
of the Azerbaijan Republic.
7.2. If efforts towards solution of arguable conditions related to the
registration and administration of domain name by negotiations don’t give
positive results, then parties can properly apply to jury or courts of
the Azerbaijan Republic.
